الملخص

هدفت هذه الدراسة إلى ابراز اسهام اتفاقية تريبس في تعزيز الحماية على الأصناف النباتية الجديدة خاصة في ظل تنامي حدة الانتهاكات عليها كالقرصنة وتقليد وما شببها من عمليات التي من شئنها التأثير على نمو وتطور علم الاحياء والاختراعات البيوتكنولوجية. خلصت الدراسة إلى أنّ حماية المبتكرات النباتية الجديدة خاصة والبيوتكنولوجية عامة يدخل ضمن قائمة الاختراعات العلمية، وهذا ما تسعى الاتفاقية إلى ترسيخه عبر ادراج أنظمة حماية خاصة تتسم بمرونة والفعالية من خلال توليفات مميزة يدمج فيها نوعين من الحماية شريطة ألا يتعارض اختيار نوع الحماية مع السياسات الكبرى للدولة صاحبة الاختراع Abstract: This study aimed to highlight the contribution of the TRIPS Agreement to strengthening the protection of new plant varieties, particularly in light of the increasing severity of violations against them, such as piracy, counterfeiting and similar operations that could affect the growth and development of biological and biotechnological inventions. The study concludes that the protection of new plant innovations in particular and biotechnological innovations in general is included in the list of scientific inventions, and this is what the agreement seeks to consolidate by including special, flexible and effective through distinct combinations that combine two types of protection, provided that the choice of the type of protection does not conflict with major state policies
