الوالي والمجلس البلدي في القانون التونسي: قراءة على ضوء مجلة الجماعات المحلية لسنة 2018

الملخص
تمثل الدائرة الترابية للولاية في القانون التونسي الفضاء الذي يحتضن جزءًا هامًا من مكونات الجماعات المحلية وخاصة منها المجلس البلدي الذي يعتبر المؤسسة الأقرب إلى المواطن الامر الذي دفع المشرع لمزيد الاهتمام بها وتطويرها هيكليا ووظيفيا ودعما مديا لمساعدتها على القيام بمهامها. تبحث هذه الدراسة من خلال قراءة النصوص القانونية ذات الصلة بالجماعات المحلية في العلاقة التي تجمع الوالي باعتباره ممثل الدولة والحكومة في حدود الدائرة الترابية للولاية مع المجالس البلدية بعد التطور الذي عرفته المنظومة القانونية بعد اصدار دستور 27 جانفي 2014 والقانون الأساسي المتعلق بمجلة الجماعات المحلية التي عملت على تطوير المجالس البلدية هيكليا ووظيفيا ودعم استقلاليتها مقابل تراجع ملحوظ لسلطة الوالي على المجالس البلدية. In Tunisian law, the Territorial Department of the State represents the space that encompasses an important part of the components of local authorities, in particular the Municipal Council, considered as the institution closest to the Citizen, which prompted the legislator to pay more attention to it, to develop it structurally and functionally, and to provide financial support to help it carry out its tasks. This study examines, through the reading of legal texts relating to local communities, the relationship that unites the governor as representative of the State and the government within the territorial circle of the state with the municipal councils after the evolution that the legal system experienced after the publication of the Constitution of January 27, 2014 and the Fundamental Law on the control of local communities, who worked to develop the municipal councils structurally and functionally and to support their independence in exchange for a significant decrease in the governor's authority over the municipal councils. En droit tunisien, le Département territorial de l'État représente l'espace qui englobe une partie importante des composantes des collectivités locales, en particulier le Conseil municipal, considéré comme l'institution la plus proche du Citoyen, ce qui a incité le législateur à lui accorder plus d'attention, à le développer structurellement et fonctionnellement, et à lui apporter un soutien financier pour l'aider à mener à bien ses tâches. Cette étude examine, à travers la lecture des textes juridiques relatifs aux communautés locales, la relation qui unit le gouverneur en tant que représentant de l'État et du gouvernement au sein du cercle territorial de l'État avec les conseils municipaux après l'évolution que le système juridique a connue après la publication de la Constitution du 27 janvier 2014 et de la Loi Fondamentale sur le magazine des communautés locales, qui a travaillé à développer structurellement et fonctionnellement les conseils municipaux et à soutenir leur indépendance en échange d'une baisse significative de l'autorité du gouverneur sur les conseils municipaux.
