الجماعات المحلية في القانون التونسي والقانون الجزائري: قراءة على ضوء الدستور التونسي المؤرخ في 25 جويلية 2022 والتعديل الدستوري في الجزائر المؤرخ في 30 ديسمبر 2020

الملخص
تجسد الجماعات المحلية قناعة المشرع بضرورة تكريس أسلوب اداري ديمقراطي يكون أكثر قرب من المواطن وأكثر نجاعة وفاعلية في تحقيق المصلحة العامة ومواكبة التطور الاقتصادي والاجتماعي وتجاوز نقائص الأسلوب التقليدي في إدارة الدولة. حاول المشرع الجزائري والمشرع التونسي تجسيد هذا التوجه على مستوى النص الدستوري من خلال تبنيه لخيار اللامركزية في إدارة الدولة والذي دعمه بأليات قانونية متنوعة لضمان نجاحه في المهام التي كلفه بها. هذه الرغبة في تبني خيار ديمقراطي في إدارة الدولة، خاصة في ظل هشاشة التكريس الدستوري للامركزية، تحتاج إلى دعم وتوفير ضمانات إضافة تضمن نجاح الجماعات المحلية في مهامها وذلك خاصة على مستوى توفير الموارد المالية والبشرية الضرورية وتوفير إطار رقابي مساعد. Local communities embody the legislator's conviction of the necessity of devoting a democratic administrative method that is closer to the citizen and more efficient and effective in achieving the public interest and keeping pace with economic and social development than the traditional method of state administration. The Algerian legislator and the Tunisian legislator tried to embody this approach at the level of the constitutional text by adopting the option of decentralization in the administration of the state, which he supported with various legal mechanisms to ensure his success in the tasks assigned to him. This desire to adopt a democratic choice in the administration of the state, especially in light of the fragility of the constitutional consecration of centralization, needs support and the provision of additional guarantees that guarantee the success of local groups in their tasks, especially at the level of providing the necessary financial and human resources and providing an auxiliary oversight framework.
