حماية الذكاء الاصطناعي عن طريق قانون حقوق الملكية الصناعية

الملخص
يهدف هذا المقال الى تسليط الضوء على مدى ترابط حقوق الملكية الصناعية بتطبيقات الذكاء الاصطناعي الذي يعد جزء لا يتجزأ منها، بحيث نجد ان الذكاء الاصطناعي أصبح عنصر فعال في عدة مجالات وقطاعات وهذا نتيجة التطور التكنولوجي الحاصل في الفترة الأخيرة، وبات ينافس عناصر الملكية الصناعية في ذلك، ففي هاته الدراسة قمنا بطرح إشكالية هل قوانين الملكية الصناعية كفيلة بحماية الذكاء الاصطناعي، وقد تناولنا في المحور علاقة الذكاء الاصطناعي بالحقوق الملكية الصناعية، اما في المحور الثاني حماية المقررة للذكاء الاصطناعي عن طريق قوانين الملكية الصناعية، وفي الأخير تم التوصل الى ان قوانين الملكية الصناعية لا توفر الحماية الكاملة والشاملة لتطبيقات الذكاء الاصطناعي بمقارنتها مع حقوق الملكية الأدبية والفنية. Summary : This article aims to highlight the existing relationship between industrial property law and AI (Artificial Intelligence) applications. In this specific context, the issue is to know to what extent the legal and regulatory framework relating to industrial property guarantees the protection of artificial intelligence. Thus, first, the relationship between artificial intelligence and industrial property rights is examined. Secondly, the protection of artificial intelligence is addressed in the light of the regulatory framework on industrial property. Finally, the industrial property legal framework does not offer a complete and exhaustive protection of the applications related to artificial intelligence compared to the literary and artistic property rights laws. .Résumé : Le présent article vise à souligner les relations existantes entre le droit de la propriété industrielle et les applications d’IA (Intelligence artificielle). Dans ce cadre précis, le problème posé étant celui de savoir dans quelle mesure le dispositif juridique et réglementaire portant sur la propriété industrielle garantit-il la protection de l’intelligence artificielle. Ainsi, dans un premier temps, la relation entre l’intelligence artificielle et les droits de propriété industrielle est examinée. Dans un second temps, la protection de l’intelligence artificielle est abordée à la lumière du dispositif réglementaire portant sur la propriété industrielle. Enfin, il s’avère que ce dispositif portant sur la propriété industrielle n’offre pas une protection complète et exhaustive des applications de l’intelligence artificielle en comparaison avec les droits de la propriété littéraire et artistique.
