الملخص
وفّر قانون نزع الملكية رقم 91-11 المعدل والمتمم للمنزوع ملكيتهم وأصحاب الحقوق العينية العقارية ضمانات لحماية أملاكهم من تعسف الإدارة، تتمثل في ضمانة التحقيق الإداري المسبق في المنفعة العمومية تقوم به لجنة مختصة يعينها الوالي المختص إقليميا، وضمانة إعلام المواطنين المعنيين عن طريق النشر واللصق والإشهار والتبليغ لضمان إشهار واسع النطاق للمشروع، وكذلك الضمانة القضائية عن طريق حق ممارسة دعاوى الإلغاء والتعويض في آجال استثنائية قصيرة مكرسا الأثر الموقف.
