مبدأ الحرية وحدود ممارستها

الملخص
انشغلت مختلف المجتمعات منذ القدم بأهم شيء في حياتهم وهي الحرية،حيث تسعى كل شعوب العالم الى الوصول الى اكتساب وتحقيق اكبر قدر من الحرية حسب ما تحتويه الكلمة من معاني وأبعاد،إلا أن الحرية تختلف حسب البيئة الاقتصادية والاجتماعية والسياسية والدينية لكل دولة،ويلزم تحديد أبعاد الحرية حتى لا تصطدم بحقوق الآخرين وذلك عن طريق وضع لها أساس داخلي دستوري وعالمي دولي عن طريق الاتفاقيات والمواثيق الدولية المهتمة بحقوق الإنسان،فالحرية مرتبطة بالكائن الإنساني وتشكل حجر الزاوية بالنسبة لحقوق الإنسان كلما اهتمت الدولة بالحرية كلما اكتسبت تأييد ورضا سكانها ورضا المجتمع الدولي،الا ان الحرية المطلقة لا نستطيع تجسيدها على ارض الوقع لأنها تعترضها ضوابط هامة تتعلق بالكيان الإنساني كم هو الحال بمبادئ الكرامة الإنسانية والمساواة .فالشخص يكون حر متى التزم بالقانون المحلي والدولي والمبادئ الإنسانية المشروعة. Since ancient times, various societies have been preoccupied with the most important aspect of their lives, which is freedom. Every nation strives to acquire and achieve the greatest degree of freedom according to the various meanings and dimensions the term encompasses. However, freedom varies according to the economic, social, political, and religious environment of each country. It is necessary to define the dimensions of freedom so as not to conflict with the rights of others, achieved through establishing internal constitutional and international foundations via agreements and international treaties concerned with human rights. Freedom is linked to the human being and constitutes the cornerstone of human rights. The more a state emphasizes freedom, the more it gains the support and satisfaction of its inhabitants and the international community. However, absolute freedom cannot be realized in reality because it is hindered by important constraints related to the human entity, such as principles of human dignity and equality. A person is considered free when they adhere to local and international law and legitimate humanitarian principles.
