تنفيذ أحكام التحكيم و الإشكالات التي تعترضها

الملخص
ملخص إن مسألة تنفيذ أحكام التحكيم الوطنية لا تثير أية إشكالية، وذلك لأنها تخضع لقواعد التنفيذ التي يتضمنها قانونها الوطني. إلا أن الإشكال يظهر لما يتعلق الأمر بتنفيذ أحكام تحكيم أجنبية، صدرت خارج إقليم الدولة المراد التنفيذ لديها، وخارج الأطر التي يحددها قانونها الداخلي لهذا الغرض. حيث تكتسي مسألة الاعتراف بأحكام التحكيم وتنفيذها أهمية بالغة، كونها تشكل المسعى الأساسي للعملية التحكيمية برمتها. لذلك يحرص المشرع في الدولة المراد التنفيذ لديها على إخضاع هذه الأحكام لرقابة القضاء الوطني، كما يسمح له ببعض الصلاحيات لمرافقة المحكمين أثناء سير إجراءات التحكيم. لذلك يجب توضيح المقصود من الاعتراف والتنفيذ، وكذا المغزى من تمكين القاضي الوطني من التدخل في الخصومة قبل إصدار الحكم لأجل المرافقة وتقديم العون لكل من الخصوم والمحكمين، وكذا التدخل بعد إصدار الحكم لأجل ممارسة الرقابة القضائية على هذا الأخير. الكلمات المفتاحية: الاعتراف تنفيذ أحكام التحكيم الوطنية الأجنبية. Abstract : The enforcement of national arbitral awards does not pose any problem because it’s subject to the enforcement rules contained in its national law. However, the problem arises when it comes to implementing foreign arbitral awards rendered outside the territory of the country to be enforced, and outside the frameworks provided for by its domestic law for this purpose. Where the issue of recognition and enforcement of arbitral awards is of great importance, as it forms the main endeavor of the entire arbitration process. Therefore, the country legislator in which the implementation is to be implemented wishes to submit these provisions to the control of its national judiciary. He also confers to him some powers to accompany the arbitrators during the arbitration proceedings. Consequently, it’s necessary to clarify recognition and enforcement as well as the importance of the national judge intervention in the dispute before rendering the judgment in order to assist both litigants and arbitrators as well as its intervention after the judgment pronouncing in order to exercise judicial control.
