Controls Of Dealing With The Technique Of Preserving Surplus Laboratory Embryos Between Sharia And Algerian Law

Abstract
The world is currently witnessing a significant advancement in medical science with the discovery of therapeutic techniques to help spouses who were born later. By creating a method for preserving extra laboratory embryos for both internal and external artificial insemination, scientists have been able to obtain positive results from these medical experiments. This paper aims to shed light on this method, which is a contemporary concern for many types of spouses who suffer from chronic illnesses or delayed reproduction. In addition, it aims to elucidate Algerian law's position about Islamic law, as well as the rationale behind its legality and the legal restrictions on managing surplus embryos. الملخص: يشهد العالم تطورا كبيرا في مجال العلوم الطبية ،وذلك باكتشاف التقنيات العلاجية في مجالات الطب المتعلقة بمساعدة الأزواج الذين تأخر حملهم على الانجاب ،فقد استطاع العلماء الحصول على نتائج ايجابية من هذه التجارب الطبية باستحداث تقنية حفظ الأجنة المخبرية الزائدة بغرض التلقيح الاصطناعي الداخلي والخارجي،وتهدف هذه المقالة إلى تسليط الضوء على هذه التقنية التي تعد من القضايا الحديثة التي تهم فئات كثيرة من الأزواج الذين يعانون تأخرا في الانجاب أو أمراضا مزمنة ،وتسعى أيضا إلى توضيح موقف الشريعة الاسلامية والقانون الجزائري منها وبيان أساس مشروعيتها وضوابط التعامل مع الأجنة الزائدة عن الحاجة من عمليات التلقيح الاصطناعي بشروط شرعية وقانونية.
