الشهادة التوثيقية على ضوء التشريع الجزائري

الملخص
تعد حادثة الوفاة هي السبب الوحيد لانتقال أموال المتوفى من منقولات و عقارات او حقوق عينية عقارية الى الورثة و/او الموصى لهم ، ولكن حتى تنتقل هذه العقارات لابد من توفر بعض الشروط التي اقرها المشرع الجزائري في قوانين الشهر العقاري واهمها ان يتم اعداد الشهادة التوثيقية التي تعد الأداة العملية لشهر ما يسمى بحق الإرث كلما تعلق الأمر بأملاك عقارية قد تركها المتوفي ، و يعني هذا أن هذه الأملاك المورثة لا يمكن ان تنتقل إلى الورثة و/ او الموصى لهم بشكل قانوني و لا يمكنهم التصرف فيها إلا عن طريق تحرير و شهر الشهادة التوثيقية من طرف الموثق بطلب من أصحاب الحق في اجال قانونية محددة ، فاشتراطها من طرف المشرع يرجع لأهميتها فهي وسيلة للحفاظ على سلسلة انتقال الملكية العقارية ، كما أنها تساعد في انتقال الملكية العقارية بسرعة و بأقل التكاليف.
