الملخص
تهدف هذه الدراسة إلى معالجة موضوع حق المرأة في الاشتراط في عقد الزواج، باعتباره من أهم الحقوق المرتبطة بمسائل الزواج، وتقوم فيها بتكريس مبدأ سلطان الإرادة لتعديل من آثار العقد بتحقيق منفعة خاصة، بحيث نظم كل قانون الأسرة الجزائري والمواثيق الدولية ذلك الحق، بهدف تعزيز مساواة بين الجنسين وحماية حقوقها، وتوفر تلك الأحكام إطارًا قانونيًا لذلك، وجاء قانون الأسرة الجزائري يكفل هذا الحق بموجب المادة 19 منه، بمنح الحق للزوجة بوضع ما تراه ضروريا من شروط في عقد الزواج، على أن لا تخالف أحكام هذا القانون، في حين أن المواثيق الدولية لم تتطرق لهذا الموضوع على وجه التحديد، إلا أنها تحث الدول الأطراف فيها على ضرورة حماية حقوق المرأة في مجال الزواج وتحديد الشروط التي تضمن المساواة بين الجنسين في هذا الجانب. This study aims to address the topic of women's right to specify conditions in the marriage contract, considering it one of the most important rights related to marriage issues. It dedicates itself to the principle of the sovereignty of will to modify the effects of the contract to achieve a particular benefit. Both Algerian family and international conventions regulate this right, aiming to enhance gender equality and protect women's rights. These provisions provide a legal framework for this purpose. Algerian family law guarantees this right according to Article 19, granting the wife the right to stipulate necessary conditions in the marriage contract, provided they do not contradict the provisions of this law. While international conventions do not specifically address this issue, they urge the member states to protect women's rights in the field of marriage and to define conditions that ensure gender equality in this aspect.
