الفقه الإسلامي المعاصر بين عصرنة الاجتهاد وتجديد المنهج Contemporary Islamic Jurisprudence Between Modernization Of Ijtihad And Methodological Renewal

الملخص

في إطار أزمة المنهج في الدراسات الفقهية المعاصرة، قدم الباحث هذه الدراسة التي عنونها: "الفقه الإسلامي المعاصر بين عصرنة الاجتهاد وتجديد المنهج" والتي تطرح الاشكالية التالية: ما المقصود بالفقه الإسلامي المعاصر، وما صوره وضوابطه، وما هو واقع الدراسات الفقهية المعاصرة، وما هي أسس تجديد المنهج الفقهي فيها؟ وللإجابة عن هذه التساؤلات قسم الدراسة لخمسة مباحث: الأول: لبيان مفهوم الفقه الإسلامي المعاصر، والثاني: لصور الاجتهاد الفقهي في العصر الحاضر وضوابطه، الثالث: لواقع ومستقبل التجديد المنهجي للفقه الإسلامي المعاصر، والرابع: لمعالم وضوابط التعامل مع فقه الواقع وقضايا العصر، والخامس: عبارة عن تصور ومقترح جديد للتجديد الفقهي المنهجي للفقه الإسلامي. ومن نتائج البحث: أن تكوين فقهاء معاصرين لابد أن يجمع بين الأصالة والمعاصرة وبين الاجتهاد والتجديد والعقل والنقل والوسطية والاعتدال. Within the context of the methodological crisis in contemporary jurisprudential studies, the researcher presents this study titled: "Contemporary Islamic Jurisprudence between the Modernization of Ijtihad and Methodological Renewal." The study raises the following issues: What is meant by contemporary Islamic jurisprudence, its forms, and criteria? What is the reality of contemporary jurisprudential studies, and what are the foundations of methodological renewal in them? To answer these questions, the study is divided into five sections: The first elucidates the concept of contemporary Islamic jurisprudence, the second discusses the forms of jurisprudential ijtihad in the present age and its criteria, the third examines the reality and future of methodological renewal in contemporary Islamic jurisprudence, the fourth highlights the features and criteria for dealing with the jurisprudence of reality and contemporary issues, and the fifth presents a new vision and proposal for methodological jurisprudential renewal in Islamic jurisprudence. Among the research findings is that the formation of contemporary jurists must combine authenticity and modernity, ijtihad and renewal, reason and tradition, moderation and temperance.
