الملخص
ملخص: يتناول هذا البحث موضوع الاجتهاد في تحقيق مناط الحكم الشرعي عند "علماء جمعية العلماء المسلمين الجزائريين"، والاجتهاد في مناط الحكم الشرعي استنباطا وتنزيلا لا يُقْدم عليه إلا من قامت به أوصاف الاجتهاد كـ"علماء جمعية العلماء المسلمين الجزائريين"، والذي يَبرز من خلاله أنّ الشريعة الإسلامية صالحة لكل زمان ومكان؛ لاستيعابها جميع الوقائع والمستجدات. هذا والاجتهاد في التطبيق لا يقل أهمية عن الاجتهاد في الاستنباط؛ فهو صِنْوُه ويخضع لضوابط ينبغي أن يراعيها المجتهد، وأن يحيط بها ليسلم له تنزيل الحكم على محلّه، وقد أوردت بعض التطبيقات التي يتبين من خلالها كفاءة وقدرة "علماء جمعية العلماء المسلمين الجزائريين"، لما تميّزوا به من فهم دقيق، ونظر ثاقب، وعناية شديدة برعاية ضوابط الاجتهاد في مناط الحكم الشرعي. كلمات مفتاحية: جمعية العلماء المسلمين الجزائريين، تحقيق المناط، الاجتهاد، أقسام المناط، تطبيق الحكم الشرعي. Abstract: This research addresses the topic of ijtihad (independent legal reasoning (in achieving the areas of Islamic jurisprudence among the "scholars of the Algerian Muslim Scholars Association". Ijtihad in the areas of Islamic jurisprudence, as an inference and implementation, is only undertaken by those who possess the qualities. of ijtihad, such as the "scholars of the Algerian Muslim Scholars Association". It highlights that Islamic Sharia is applicable to every time and place, as it encompasses all events and developments. Moreover, the importance of ijtihad in application is no less than ijtihad in inference, as it is its refinement and is subject to regulations that the mujtahid (one who exercises ijtihad) should consider and abide by in order to rightly issue judgments in their place. Some applications are presented, demonstrating the efficiency and capability of the "scholars of the Algerian Muslim Scholars Association", distinguished by their precise understanding, insightful vision, and keen attention to upholding the regulations of ijtihad in the areas of Islamic jurisprudence.
