الملخص
الملخص: يعد الاستثمار أحد الاليات الاساسية لبلوغ التطور الاقتصادي، كما يعتبر العقار العنصر الرئيسي في تجسيد المشروع الاستثماري، لذلك وجب اخذ الاعتبار لهذه المعادلة المركبة ضمن سياسة الدولة في سبيل تحقيق تنميتها، ونترجم الاخذ بهذ المعادلة انه ولأول مرة في قانون الاستثمار الجديد 22-18 اصبح توفير العقار الاقتصادي من الضمانات الممنوحة للمستثمرين، كما ان إصداره للقانون 23-17 المحدد لشروط وكيفيات منح العقار التابع للاملاك الخاصة للدولة الموجه لانجاز المشاريع الاستثمارية يعكس جدية الدولة واعطائها اهمية للاستثمار بهدف تحسين مناخه. وتماشيا مع تطبيق ما تقتضيه حوكمة العقار كلف المشرع الوكالة الجزائرية لترقية الاستثمار بتوجيه ومنحه وتسييره باعتبارها الأدرى بشؤون الاستثمار والمستثمرين، ورغم كل المساعي والجهود التي بذلتها الدولة لوضعه بجميع انواعه في خدمة التنمية الا انه يتعين التأكد من مدى استعماله واستغلاله في النشاط الاقتصادي حيث يكون دفعا حقيقيا للنمو الاقتصادي وليس هدرا للاملاك الخاصة بالدولة. Abstract: Investment is one of the basic mechanisms for achieving economic development, and economic real estate is considered the main element in the embodiment of the investment project. Therefore, this complex equation must be taken into account within the state’s policy in order to achieve economic development. We translate the adoption of this equation by the Algerian legislator as, for the first time in investment law. The new 22-18 has become the provision of economic real estate among the guarantees granted to investors, and the legislator issued Law 23-17 to specify the conditions and methods for granting economic real estate belonging to the state’s private property directed to the completion of investment projects, and this reflects the seriousness of the state and its giving of importance to investment with the aim of improving the investment climate. In line with the application of governance requirements in the field of real estate, the legislator assigned the Algerian Investment Promotion Agency to direct, grant and manage economic real estate, as it is the most knowledgeable about investment and investor affairs. Despite all the endeavors and efforts made by the state to place all types of real estate in the service of economic development, it must ensure the extent of its use and exploitation in Economic activity is a real impetus for economic growth and not a waste of the state’s property.
