الروبوت الذكي بين إشكالية الإعتراف بالشخصية القانونية و إنكارها

الملخص
الملخص: بالنظر للخصوصية التي يتمتع بها الرّوبوت الذكي أو الإنسان آلة، فإن تحديد موضعه من أشخاص القانون يثير الكثير من الجدل من حيث أحقية الرّوبوت الذكي بالشخصية القانونية، حيث أن الانسان آلة يحتاج إلى بحث في المفهوم و كذلك الخصائص، إضافة إلى أن البحث في إشكالية الاعتراف بالشخصية القانونية للرّوبوت الذكي من عدمه، يثير جدلا فقهيا و قانونيا، بعضه قائم على وجهة نظر تستشرف إلى المستقبل مفادها الاعتراف بالشخصية القانونية للرّوبوتات الذكية، في حين يرى جانب آخر بأنه لا يتوافر على أي أساس ومازال يعتبر سابقا لأوانه، حيث لا يجوز منح الشخصية القانونية للرّوبوت لأن هذا من شأنه أن يطرح مشاكل أخلاقية وقانونية. abstract: In view of the privacy enjoyed by a smart robot or a human being a machine, determining its position among the legal persons raises a lot of controversy in terms of the eligibility of the intelligent robot to the legal personality, as the human being is a machine that needs research in the concept as well as the characteristics, in addition to the research in the problem of recognizing the legal personality Whether or not a smart robot is a matter of jurisprudence and legal debate, some of which is based on a point of view that looks forward to the future is the recognition of the legal personality of smart robots, while another side believes that it is not available on any basis and is still considered premature, as it is not permissible to grant legal personality to a robot because This would pose ethical and legal problems.
