الملخص
ترتبط فعالية المشروع الاستثماري ونجاحه بمدى ملائمة مناخ الاستثمار داخل الدولة، ومن أهمها ثبات المنظومة القانونية التي تنظم نشاط الاستثمار وتحمي الحقوق المالية للمستثمرين، وتُعَامِلهم على قدر من المساواة، وسواء كان المستثمر وطنيا أو أجنبيا فهو يركز على قدرة الآليات القانونية المتاحة على التعامل مع التحديات التي قد تواجه مشروعه، ولعل أبرز ما جاء به قانون الاستثمار الجديد, هو تنويع ضمانات التكفل بفض كل الاشكالات التي قد تثور بين المستثمر والدولة، وتتمثل هذه الضمانات في حق المستثمر اللجوء إلى اللجنة الوطنية العليا للطعون، أو اللجوء للوسائل البديلة، أو للجهات القضائية المختصة، ومنه فجملة الضمانات التشريعية ومرونة الجهاز الإداري المشرف على تسيير ومتابعة عمليات الاستثمار والاستقرار السياسي والنمو الاقتصادي ومكافحة الفساد, كل ذلك له دور بارز في تشجيع الاستثمارات. The effectiveness and success of investments are related to the suitability of the investment climate within the country. The most important one is the consistency of the legal system that regulates investment activity and protects the financial rights of investors, also, It treats them equally. Whether the investor is local or foreign, He focuses on the capability of the available legal mechanisms to handle the challenges that may face his project, Perhaps one of the most prominent aspects brought about by the new investment law is the diversification of guarantees that handle all problems may occur between the investor and the state. These guarantees are represented in the right of the investor to turn to the supreme national committee for Appeals, or the competent judicial authorities, or going to the alternative mechanisms. Thus, the union of legislative guarantees, the flexibility of the administrative system which controls management and the follow-up of investment operations. The stability of the political side, economic growth and the fight against corruption, all of these have a prominent role to encouraging investments.
