الدفوع الابتدائية لدولة ميانمار أمام محكمة العدل الدولية بخصوص قضية أقلية الروهينجا - Preliminary Objections Of The State Of Myanmar Before The International Court Of Justice On The Issue Of The Rohingya Minority

الملخص

الملخص: أودعت دولة غامبيا بتاريخ: 11 نوفمبر 2019 شكوى ضد دولة ميانمار أمام محكمة العدل الدولية، بغية تحميلها مسؤولية إخلالها بالتزاماتها المنبثقة عن اتفاقية منع جريمة الإبادة الجماعية و المعاقبة عليها المبرمة في سنة 1948، بسبب ما ارتكبته من انتهاكات جسيمة لحقوق الإنسان ضد أقلية المسلمين الروهينجا خلال سنتي 2016 و2017، لترد عليها ميانمار بمجموعة من الدفوع الابتدائية قصد عرقلة مسألة اختصاص المحكمة للنظر في هذه الشكوى، و بعد دراسة هذه الهيئة القضائية الدولية لتلك الدفوع، أعلنت موقفها منها بموجب حكمها الصادر بتاريخ: 22 جويلية 2022. فيهدف المقال إلى إبراز أهم التفاصيل المتعلقة بتلك الدفوع و كذلك تبيان أسانيد الأجوبة القانونية للمحكمة بخصوصها، و هذا لما تثيره قضية هذا النزاع ما بين دولتي غامبيا و ميانمار من إشكالات قانونية عديدة، خاصة و أن الضحايا من أقلية المسلمين الروهينجا لا تربطهم أي رابطة قانونية مع الدولة الشاكية غامبيا. :Abstract On November 11, 2019, the state of Gambia filed a complaint against the state of Myanmar before the International Court of Justice, in order to hold it responsible for its violation of its obligations arising from the convention on the prevention and punishment of the crime of genocide concluded in 1948, because of its grave violations of human rights committed against the Rohingya muslim minority during the years 2016 and 2017, to which Myanmar responded with a set of preliminary objections in order to obstruct the issue of competence of the court to adjudicate this complaint. After studying these objections ,this court announced its position on them in accordance with its judgment issued on July 22, 2022. This article aims to outline these preliminary objections and the basis of the court's legal answers to them, especially since the victims of the Rohingya minority do not have any legal association with the state of the Gambia
