الملخص

تعتبر اللجان الإدارية المتساوية الأعضاء جزء لا يتجزأ من نظام الوظيفة العامة والمرفق العام، فقد أسند القانون لها مهام توسعت وتطورت بتطور الوظيفة العامة وعلاقة الموظف بالإدارة، وحتى يحمي المشرع الموظف من تعسف الإدارة اتجاهه. فقد أنشئت هذه اللجان التي تشكل مظهرا من مظاهر مشاركة ومساهمة الموظف في تسيير حياته الوظيفية في الجزائر لأول مرة في قانون الوظيفة العمومية رقم 66-133. ثم توال النص عليها في مختلف النصوص القانونية للوظيفة العمومية وآخرها الأمر رقم 06-03 المتضمن القانون الأساسي العام للوظيفة العمومية. كما أعيد تنظيمها مؤخرا بصدور المرسوم التنفيذي رقم 20-199 الذي حدد من خلاله المشرع تنظيم اللجان الإدارية المتساوية الأعضاء في المؤسسات والإدارات العمومية من خلال تشكيلتها واختصاصاتها وسير عملها. The administrative committees with equalmembers are an integral part of the sysem of the public service and the public facility.the law has assgined them tasks that have expannded and developed with the developmeent of the public job and the employee,s relationship with the administration, and in order to protect the legislator from the abuse of the administation towards him these committees which constitute a manifestation of the employee,s participation and contribution in the conduct of his career in algeria, were established for the first time in the public service law 66-133. Then it was stipulated in various legal texts related to the public service, the last of which was ordre 06-03 containing the general basic law for the pudlic service. It was also recently reorganized with the issuance of executive decree no. 20-199, through which the ligislator specified the organization of equal administrative committees’ members in public institution and administrations through their formation, fouctions and workflow.
