الاستجواب البرلماني للحكومة عن حال تطبيق القوانين في ضوء التعديل الدستوري الجزائري لسنة 2020

الملخص
الملخص: عرف التعديل الدستوري الجزائري لسنة 2020 العديد من المستجدات خاصة في مجال الرقابة البرلمانية من خلال التوسيع من نطاق استخدام آلية استجواب الحكومة عن أية مسألة ذات أهمية وطنية وكذا عن حال تطبيق القوانين، وقد حاولنا من خلال هذه الدراسة التركيز على حال تطبيق القوانين كموضوع لاستجواب الحكومة من طرف اعضاء البرلمان، حيث تم كمرحلة أولى ابراز كل من مفهوم الاستجواب وخصوصيته ذات الطابع الاتهامي وما يميزه عن باقي الآليات الرقابية البرلمانية الأخرى، وكذا أهميته وأهدافه من حيث كونه أداة هامة من حيث الاستخدام، أيضا من حيث كونه أداة تسعى لتحقيق العديد من الاهداف والغايات. وكمرحلة ثانية حاولت الدراسة تحديد مضمون حال تطبيق القوانين كموضوع لاستجواب الحكومة، وكذا ابراز أسباب اللجوء إلى الاستجواب عن حال تطبيق الحكومة للقوانين، وفي هذا الصدد كان لابد من تناول إجراءات البت في الاستجواب من خلال تبيين شروطه الشكلية والموضوعية. ا Abstract: The Algerian constitutional amendment of 2020 introduced many developments, particularly in the area of parliamentary oversight, by expanding the scope of the government's interrogation mechanism on any matter of national importance, as well as on the state of law enforcement. We have tried through this study to focus on the state of the application of the laws as a subject of interrogation of the government by parliamentarians. We first dealt with the definition of the concept of interrogation and its accusatory specificity and what distinguishes it from other parliamentary oversight mechanisms, as well as its importance and purposes as an important tool in terms of use, also as a tool that seeks to achieve many goals and objectives. Next, the study attempted to determine the content of law enforcement status as a subject of governmental inquiry, as well as to highlight the reasons for the use of enforcement status inquiry. governmental laws. In this respect, it was necessary to approach the methods of decision of the interrogation by specifying its formal and objective conditions.
