الحصانة البرلمانیة وتطبیقاتها في التشریع الجزائري

الملخص
ملخص: يمثل البرلمان أحد أهم المؤسسات التي تمارس فيها الديمقراطية النيابية، و على هذا الأساس تحرص معظم التشريعات والنظم و منها الجزائر على توفير كافة الضمانات التي تعزز من فعالية الأداء البرلماني، و هذه الضمانات تتجسد في منح الحصانة البرلمانية للنواب أو الأعضاء من اجل تمكينهم من حسن أداء مهامهم التمثيلية بكل حرية و دون قيود أو مضايقات من أية جهة كانت، ومن هنا تبرز أهمية هذه الحصانة بشقيها الموضوعي والإجرائي، وهو ما تهدف هذه الدراسة إلى إثارته من خلال البحث في موضوع الحصانة البرلمانية و تحديد مضمونها ومدى تكريسها وكيفيات تطبيقها في التشريع الجزائري. الكلمات الدالة: الحصانة البرلمانية الموضوعية، الحصانة البرلمانية الإجرائية، تكريس الحصانة البرلمانية ، تطبيقات الحصانة البرلمانية، التشريع الجزائري. Abstract: Parliament is one of the most important institutions in which representative democracy is practiced, and on this basis most of the legislation and systems, including Algeria, are keen to provide all guarantees that enhance the effectiveness of parliamentary performance, and these guarantees are embodied in granting parliamentary immunity to the representatives and members in order to enable them to perform well. Their representative duties are totally and without restrictions or harassment from any party whatsoever, and hence the importance of this immunity, in both its substantive and procedural parts, which is what this study aims to raise by researching the issue of parliamentary immunity, defining its concept, the extent of its consecration, and how to apply it in Algerian legislation.
