رقابة المجلس الدستوري علی صحة الانتخابات والاستفتاء في ضوءالتشریع الجزائري الحالي

الملخص
ملخص الدراسة: يلعب المجلس الدستوري الجزائري، منذ نشأته دورا كبيرا في تحصين دعائم دولة القانون، باعتباره مؤسسة دستورية تسهر على علوية الدستور وسمو أحكامه، و لعل من ابرز اختصاصاته الأساسية، فضلا عن الرقابة على مدى دستورية القوانين، وكذا بعض المهام الاستشارية الأخرى، تلك الاختصاصات المتعلقة بمجال الرقابة على الانتخابات وعملية الاستفتاء، وهو دور تتجلى أهميته في مدى حرص المجلس على ضمان سير العملية الديمقراطية في أحسن الظروف، مما قد ينعكس إيجابا على إرساء مقومات دولة القانون. و في ظل الوضع الحالي لما تعيشه الجزائر، من عملية تحول كبيرة منذ 22 فيفري 2019، و ما صاحب ذلك من مطالب شعبية على رأسها، العمل على تعزيز سير قواعد العملية الديمقراطية، نحاول ابراز الدور الرقابي الهام للمجلس الدستوري على صحة الانتخابات والاستفتاء، في ظل التشريع الجزائري الحالي. الكلمات المفتاحية: المجلس الدستوري، الرقابة على الانتخابات الرئاسية والتشريعية، الرقابة على الاستفتاء، التشريع الجزائري. StudySummary: Since its creation, the Algerian constitutional council has played an important role in consolidating the foundations of the rule of law, as a constitutional institution which ensures the supremacy of the constitution, apart from other fundamental specialties, the council has an attached role of monitoring the elections and referendum, is a role which ensures the functioning of the democratic process in the best conditions, which can have a positive reflection on the establishment of the foundations of the rule of law. In the current situation of what Algeria, has been going through from a major transformation process since February 22, 2019, and the accompanying popular demands on top of which, to work to strengthen the functioning of the rules of the democratic process, we are trying to highlight the important oversight role of the constitutional council regarding the validity of the elections and referendums, in the current Algerian legislation.
