المسؤولية المدنية المترتبة عن الجراحة التجميلية

الملخص
أصبحت الجراحة التجميلية من أكثر الأعمال رواجا في عصرنا الحالي، فلم يعد دور الطبيب مقتصرا على علاج المرض ، بل أصبح يستهدف تحسين الشكل وإزالة العيوب الموجودة في الجسم، سواء كانت خلقية أو مكتسبة، وقد انتشرت الجراحة التجميلية بشكل لافت في الآونة الأخيرة، وهو ما استدعى ضرورة البحث في مضمونها والمسؤولية المدنية المترتبة عنها، لما ينجر عنها من مخاطر تبدو أكثر أهمية مقارنة بالجراحة العادية، لأنها لا تمارس لعلاج مرض ما بل رغبة في تجميل المظهر. وتتجلى أهمية هذا الموضوع في كونه متعلقا بجسم الإنسان وما يقتضيه من حرمة، كما أنه يرتبط بالتطور الطبي الباهر في مجال الجراحة الطبية بصفة عامة والتجميلية بصفة خاصة. أما الهدف من هذه الدراسة فكان يتعلق بإبراز خصوصية هذه الجراحة والمسؤولية المدنية المترتبة عنها، فقد شدد القضاء على مسألة الحصول على رضا المريض وأن يكون حرا وصريحا ، وألزم الطبيب بتقديم إعلام كاف وواف ، كما أقر بأن التزام جراح التجميل يكون التزاما ببذل عناية مشدد. Plastic surgery has become one of the most popular practices nowadays, because the role of the doctor is no longer limited to treating diseases, but rather it aims at perfecting the shape and getting rid of congenital or acquired body imperfections. Plastic surgery has noticeably spread lately, the thing that requires an extensive research on its circumstances and the incurred civil liability due to the significant related hazards compared to regular surgery, since it does not deal with a specific disease, but with the shape’s beauty. This topic is valuable because it concerns the sanctity of the human body on the one hand, and it is related to the remarkable medical development in the field of medical surgery in general and plastic surgery in particular, on the other hand. The aim of this study is highlighting the specificity of plastic surgery and its consequent civil liability, since law strongly emphasizes the need for obtaining the patient's free and explicit consent, obliges the doctor to provide sufficient and comprehensive information, and acknowledges that the plastic surgeon’s commitment should be to mind due diligence.
