مقصد التيسير وأثره في أحكام الطلاق The Facilitation Purpose And Its Impact On The Divorce Provisions

الملخص

ملخص: يهدف هذا البحث إلى إبراز مقصد عام من مقاصد الشريعة الإسلامية، ألا وهو مقصد التيسير وما مدى أثره في أحكام الطلاق، وذلك ببيان حقيقته وما يتعلّق به من مسائل، كحكم الطلاق، والحكمة من مشروعيته، وحكم الطلاق البدعيّ والطلاق الثلاث، وأحكام العِدّة والرَّجعة، وأحكام الطلاق من جهة أحوال المطلّق وما يطرأ عليها من جنون وغضب وإكراه وخطأٍ ونسيان، وغيرها من الأحكام المتفرقة، كتقييد الطلاق بثلاث طلقات وبعض حقوق المطلقة، كحقها في نصف المهر قبل الدخول بها، والمتعة، والإرث في مرض الموت. وقد خلُصنا من خلال هذه الدراسة إلى أنّ الشريعة الإسلامية راعت أحوال الرجل والمرأة في الطلاق، وما يطرأ عليها من شدّة وضيق وحرج، وجعلت لها نظاما دقيقاً بما يتوافق مع مقاصدها لا سيما مقصد التيسير. Abstract: This research aims to highlight a general purpose from the Islamic sharia purposes, which is the facilitation and the extent of its impact on the divorce provisions, by clarifying its truth and related issues, such as the divorce ruling, the purpose of its legitimacy, the ruling on innovated divorce and the three divorces, the rulings of waiting period and taking back, and rulings divorce from the man and what happens to him of madness, anger, coercion, mistake, forgetfulness, and other separate rulings, such as restricting it to three, and some of the divorced woman rights, such as, the dowry half before consummation with her, pleasure, and inheritance in the death disease. We have concluded through this study that the Islamic Sharia took into account the conditions of men and women in divorce, and the hardship, distress and embarrassment that befell them, and made for them an accurate system in accordance with its purposes, especially the facilitation purpose.
