Abstract

ملخص: ينتج عن الحروب والنزاعات المسلحة العديد من المخاطر على البيئة مثل الملوثات الناتجة عن التلوث البيولوجي ، النووي ، والبصري كذلك ، ولتحقيق الأمن البيئي سعى القانون الدولي الانساني إلى تكريس مجموعة من المبادئ لحماية البيئة من هذه المخاطر ويمكن تقسيم هذه المبادئ إلى قسمين ، القسم الأول يتضمن المبادئ العامة للقانون الدولي الإنساني ودورها في توفير الأمن البيئي زمن النزاع المسلح ، أما القسم الثاني فيتمثل في المبادئ الخاصة بحماية البيئة زمن النزاع المسلح ، وهي ذات علاقة مباشرة بحماية البيئة ، وهو التصنيف المعتمد في هذه الورقة البحثية لاستخلاص النتائج المترتبة عن تكريس هذه المبادئ كقواعد اساسية لضمان الأمن البيئي زمن النزاع المسلح الذي لا يزال يشهد تهديدا ملحوظا ، وهو ما يطرح اشكالية كفاية وفاعلية هذه المبادئ . Abstract: Wars and armed conflicts result in many risks to the environment, such as pollutants resulting from biological, nuclear, and visual pollution as well، In order to achieve environmental security, international humanitarian law sought to dedicate a set of principles to protect the environment from these risks. These principles can be divided into two parts. The first part includes the general principles of international humanitarian law and their role in providing environmental security in times of armed conflict. It is characterized by preventive measures., As for the second section, it is represented in the principles related to the protection of the environment in times of armed conflict, which are directly related to the protection of the environment in order to provide environmental security, It is the classification adopted in this research paper to draw the results of the consecration of these principles as basic rules for ensuring environmental security in times of armed conflict.
