الملخص
الملخص: كرست الجزائر مبدأ سمو المعاهدات الدولية على القانون الداخلي في اضيق الحدود ، حيث يخضع هذا المبدأ إلى شرط أساسي وهو احترام المعاهدة للشروط المنصوص عليها في الدستور، ونتج عن ذلك تكريس مبدأ سمو القواعد الدستورية على المعاهدة الدولية. وفي نفس الإطار تأثر الدستور الجزائري بالعديد من القواعد القانونية الدولية ، فشكلت اتفاقية " سيداو " نموذجا لذلك في هذه الدراسة ، حيث تعايش المؤسس الدستوري مع هذه الاتفاقية مكرسا مبدأ المساواة بين الرجل والمرأة في مجالات متعددة منها المشاركة في الحياة السياسية وعضوية المجالس المنتخبة في تعديل 2008 ، ومناصفة مع الرجل في سوق الشغل وفي تولي الوظائف السامية في الدولة في تعديل 2016، كما احتفظ بالنص على مبدأ المساواة بوجهه العام في كل الدساتير . Abstract :Abstract : Algeria has enshrined the principle of supremacy of international treaties to domestic law in the narrowest terms. This principle is subject to the basic requirement of respecting the treaty to the conditions stipulated in the Constitution. In this context, the Algerian Constitution founder with convention “CEDAW”, devoting the principle of equality between men and women in various fields including participation in political life, and membership of elected councils, and equality with men in the job market, and in assuming high positions in the state ; he also kept the text on the principle of equality in general in all constitutions.
