الأضرار البيئية ضمن مبادئ القانون الدولي الإنساني Environmental Damage Within The Principles Of International Humanitarian Law

الملخص
Damage to the environment in times of armed conflict is inevitable, so the rules of international humanitarian law related to the protection of the environment aim to limit these damages so that they are at a level that can be tolerated and not to be completely excluded. The international humanitarian organization to protect the victims of war is just an illusion. Armed conflicts continue, and technological development has exacerbated them and not lessened their impact, seriously affecting the application of provisions protecting victims of armed conflicts. Therefore, the protection of the natural environment under the provisions of the Geneva Conventions and Additional Protocol I is very important and must be taken into account by the conflicting parties. Considering that the environmental dimensions within the rules of international humanitarian law are embodied in a set of principles that the warring parties must take into account their provisions and abide by in such circumstances, the most important of these principles is the principle of restricting the rights of the belligerents regarding the use of means and methods of combat, the principle of proportionality and military necessity, as well as the principle of prohibition Unwarranted pain, and the distinction between civilian targets and military targets إلحاق الضرر بالبيئة في أوقات النزاع المسلح أمر لا مفر منه، لذلك تهدف قواعد القانون الدولي الإنساني المتعلقة بحماية البيئة إلى الحد من هذه الأضرار بحيث تكون عند مستوى يمكن احتماله وليس لاستبعادها نهائياً، فعندما يلحق بالبيئة أضراراً مدمرة في ميدان القتال ستجعل من الحماية التي يقررها القانون الدولي الإنساني لحماية ضحايا الحروب مجرد وهم. فالنزاعات المسلحة مستمرة، والتطور التكنولوجي زاد من حدتها، ولم يخفف من وطأتها ليؤثر الأمر بشكل خطير على تطبيق أحكام حماية ضحايا النزاعات المسلحة؛ لذلك فإن حماية البيئة الطبيعية بموجب أحكام اتفاقيات جنيف والبروتوكول الإضافي الأول هي هامة جداً ويجب أن تراعى من قبل الأطراف المتنازعة. باعتبار الأبعاد البيئية ضمن قواعد القانون الدولي الإنساني تتجسد في مجموعة من المبادئ التي يتعين على الأطراف المتحاربة مراعاة أحكامها والنزول على مقتضاها في مثل هذه الظروف، ومن أهم هذه المبادئ مبدأ تقييد حقوق المتحاربين بصدد استخدام وسائل وأساليب القتال، بمبدأ التناسب والضرورة العسكرية، وكذلك مبدأ حظر الآلام التي لا مبرر لها، والتمييز بين الأهداف المدنية والأهداف العسكرية.
