الملخص
ملخص: يقصد بالقانون الدولي الإنساني مجموعة القواعد الاتفاقية أو العرفية المنشأة والتي تستهدف تسوية المشكلات الإنسانية المترتبة مباشرة عن النزاعات المسلحة الدولية، والتي تقيد –لأسباب إنسانية- حق الأطراف في استخدام الوسائل الحربية، وكذا السبل التي تحمي الممتلكات والأشخاص المتضررين أو المحتمل تضررهم جّراء النزاع. وحتى يكفل القانون الدولي الإنساني هذه الحماية وضعت له مبادئ، وتم تعزيزه بآليات من أجل ضمان حقوق الإنسان حتى إبان الحروب والنزاعات المسلحّة. Abstract : International humanitarian law refers to the set of customary or customary rules established to settle humanitarian problems arising directly from international armed conflicts, which restrict - for humanitarian reasons - the right of the parties to use military means, as well as the means to protect property and persons affected or likely to be affected by the conflict. In order for international humanitarian law to guarantee such protection, principles have been laid down and strengthened by mechanisms for ensuring human rights even during war and armed conflict.
