الملخص
تعد حقوق الملكية الصناعية منتجات الفكر الإبداعي سواء اكانت براءات أو علامات أو رسوما ونماذج صناعية ...فهي أدوات ضرورية لكل نشاط اقتصادي. كما تتحدد القدرة التنافسية للمؤسسات الاقتصادية بحسب ما تمتلكه من حقوق صناعية إذ أصبح رأسمال الفكري مهم جدا بالنسبة لمختلف المؤسسات سواء أكانت إنتاجية أو خدماتية. في هذا المقال تم توضيح مظاهر القصور في التنظيم القانوني لحقوق الملكية الصناعية في التشريع الجزائري سواء فيما يخص تعدد النصوص القانونية المنظمة لها وعدم تناسق مضمونها وكذا محدودية أليات الاستثمار الممنوحة لمالكي هذه الحقوق. كما أن المشرع الجزائري لم ينظم العديد من الحقوق الصناعية الحديثة المهمة بالنسبة للاقتصاديات الحديثة خاصة في المجال الفلاحي. وبهذا، على المشرع الجزائري أن يصدر تقنينا يشمل مختلف حقوق الملكية الصناعية ويدرج الحديثة منها، بالإضافة إلى منح أدوات أكثر فعالية لاستثمارها. Industrial property rights are the products of creative thought, whether are patents, trademarks, industrial designees and model …they are necessary tools for every economic activity. The competitiveness of economic institutions is also determined by their industrial rights. as intellectual capital has become very important for various institutions, whether they are production or service. In this article the shortcoming in the legal regulation of industrial property in the Algerian legislation were clarified, both with regard to the multiplicity of legal texts regulating them. and the inconsistency of their content, as well as the limited investment mechanisms granted to the owners of these rights. also, the Algerian legislator did not regulate many modern industrial rights especia lly in the agricultural field. We concluded that the Algerian legislator must issue a regulation that includes various industrial property rights and includes the moderns’ ones .in addition to granting effective tools for their investment
