الضمانات الممنوحة للمدين عند حجز عقاره حجزا تحفظيا The Guarantees That Given To The Debtor When Seizures His Real Estate A Preventive Seizure

الملخص

الحجز التحفظي كوسيلة لحماية الدائن من تهريب المدين لأمواله ، و الحفاظ على الضمان العام الذي يستفيد منه الدائن ، في المقابل يجب ان يوفر المشرع الجزائري بعض الحقوق و الضمانات للمدين ، لذلك الهدف من الدراسة الحالية هي تبيان الحقوق و الضمانات التي قررها المشرع الجزائري ضمن قانون الإجراءات المدنية و الإدارية للمدين قبل و بعد الحجز التحفظي على عقاره ، فالمشرع الجزائري وضع مجموعة من القواعد القانونية التي حاول من خلالها حماية عقار المدين في الحجز التحفظي ، فقرر مجموعة من الضمانات قبل الحجز التحفظي و المتمثلة في شروط توقيعه ، ثم تمتد هذه الضمانات الى اصدار امر الحجز و تنفيذه ، مع تقرير حقوق و ضمانات أخرى حتى بعد توقيع الحجز التحفظي لحماية حقوق المدين المحجوز على عقاره تحفظيا. The Provisional seizure consider as a means to protecting the creditor from smuggling the debtor's money and maintaining the general guarantee from which the creditor benefits, in return, Algerian legislators must provide certain rights and guarantees to the debtor. The purpose of this study is to reflect the rights and guarantees established by the Algerian legislature in the Civil and Administrative Procedure Code to the debtor before and after the provisional seizure of the debtor's property; Algerian legislator has established a set of legal rules by which he tried to protect the debtor's property in Provisional seizure and decided a set of guarantees before The Provisional seizure, namely the conditions of its signature, These guarantees extend to the issuance and execution of The Provisional seizure; with the determination of rights and other guarantees even after the signing of the provisional seizure to protect the debtor's rights is Provisional seizure of his real estate.
