إشكالات التجديد في الخطاب المقاصدي وأثرها على حركة الاجتهاد الفقهي المعاصر

الملخص
لا شك أن الدراسات المقاصدية المعاصرة فتحت آفاقا للبحث والنظر الفكري والأصولي، والفقهي، مع تنامي المستجدات والقضايا الشائكة، ما استلزم تجديد منهج التأليف فيها بما يخدم النظر الاجتهادي والاستنباطي، والقائم أساسا على آليات مقاصدية تتكيف وتقرير الوسائل المناسبة تماشيا مع مقتضيات المستحدثات، ما فتح مجالا لتهيب المتزمتين وتسيب الحداثيين في النظر فيها والتجديد في قضاياها، فأحدثوا إشكالات معرفية ومنهجية من منطلقات فلسفية وعقلية، فأضحت من أكبر هموم أعلام التجديد في الفكر المقاصدي، فكثرت فيه الدراسات والأبحاث لتقويم الأنظار وتصحيح الأفهام، ما انعكس سلبا على الاجتهاد والحركة الفقهية المعاصرة التي تتوقف على الاستثمار المقاصدي في تفعليها، وتنميتها في الفكر والاجتهاد والفتوى. There is no doubt that contemporary studies of purposes (Al’Maqasid) have opened new horizons for research and intellectual, fundamentalist and jurisprudential view, with the uprising of thorny issues and updates, that required a methodological rejuvenation of authoring in what serves diligent and deductive view, based essentially on Maqasid (purposes) mechanisms that adapt along with the adoption of adequate tools that acting jointly with the needs of renewals. This opened the way for the withdrawal of conservatists and the accumulation of modernists looks into the matter and its renewal, creating intellectual and methodological problematics on cognitive and philosophical grounds becoming some of the biggest concerns of renewal pillars in Fikr Al’Maqasid, this led to many studies and researches in the purpose of straightening views and correcting concepts, which negatively reflected on diligence and contemporary movement of Fiqh (jurisprudence) that relies on conceptual investment in its activation in Al’Fikr, Al’Ijtihad and Fatwa. Les études contemporaines sur Al Maqasid ont ouvert de nouveaux horizons pour la recherche et la vision intellectuelle, mais ont également nécessité une rénovation méthodologique de l'écriture pour s'adapter aux mises à jour et aux questions épineuses. Cela a permis aux regards modernistes de s'accumuler sur la question, créant des problématiques intellectuelles et méthodologiques devenues l'une des plus grandes préoccupations des piliers de rénovation dans Fikr Al'Maqasid. De nombreuses études ont été menées pour redresser les points de vue et corriger les concepts, mais cela a eu une incidence négative sur la diligence et le mouvement contemporain du Fiqh qui repose sur l'investissement conceptuel dans son activation et son développement dans Al'Fikr, Al'Ijtihad et Al’Fatwa
