الضمانات القانونية لحماية الأسرة في الاعلانات والاتفاقيات ذات الطابع العالمي(في اطار الملتقى الدولي الأطر الحمائية للأسرة و دورها في استقرار المجتمع)

الملخص
يعتبر الحق في تكوين الأسرة الحق الأساسي الذي يشكل إحدى الدعائم الجوهرية للمجتمع، فهو من أهم حقوق الإنسان التي أكدت المواثيق والمعاهدات الدولية على ضمانه، كما دعت الدول الأطراف فيها إلى تكريس مثل هذا الحق في تشريعاتها الوطنية. إن هذه الإعلانات والمعاهدات، وخاصة المواد المتعلقة منها بالأسرة، تصطبغ بالصبغة الغربية ، دون اعتبار لثقافات الشعوب الأخرى ولا دياناتهم، وهذا ما جعل كثيرا من الدول تتحفظ على بعض هذه الاتفاقيات أو على الأقل على بعض موادها. The right to form a family is considered the basic right that constitutes one of the fundamental pillars of society. It is one of the most important human rights that international covenants and treaties have confirmed its guarantee, and called on the states parties to it to enshrine such a right in their national legislation. These declarations and treaties, especially the articles related to the family, are Western in color, without regard to the cultures of other peoples or their religions, and this is what made many countries have reservations about some of these agreements or at least some of their articles. Le droit de fonder une famille est considéré comme le droit fondamental qui constitue l'un des piliers fondamentaux de la société. C'est l'un des droits de l'homme les plus importants dont les pactes et traités internationaux ont confirmé sa garantie et appelé les États parties à le consacrer. un tel droit dans leur législation nationale. Ces déclarations et traités, en particulier les articles relatifs à la famille, sont de couleur occidentale, sans égard aux cultures des autres peuples ou à leurs religions, et c'est ce qui a fait que de nombreux pays ont émis des réserves sur certains de ces accords ou du moins sur certains de leurs des articles.
