فعالية الجزاءات الإدارية المفروضة على المؤسسات الإعلامية في الجزائر

الملخص
الملخص : اتجهت معظم الدول في تشريعاتها إلى تبني ما يسمى بالجزاءات الإدارية التي يتم فرضها من طرف الإدارة المختصة على كل مخالف للقوانين أو لوائح الضبط، وهو ما تم اعتماده من طرف المشرع الجزائري من خلال فرض جزاءات إدارية مختلفة ومتنوعة سواء على الأشخاص الطبيعية أو المعنوية المرتكبين للمخالفات الإدارية، وهي متوزعة عبر عدة قوانين تشمل مختلف القطاعات والمجالات كالضرائب والصحة العامة، إلى جانب قطاع الإعلام بكافة أقطابه المكتوب منها والسمعي والسمعي البصري، إلا أن المشرع قيد إعمال الإدارة لسلطاتها في توقيع تلك الجزاءات بضوابط قانونية تعتبر بمثابة ضمانات لحقوق الأشخاص المتعاملين معها. Abstract: The majority of countries have a tendency to adopt the so-called administrative sanctions in their legislation. These are sanctions that are imposed by the competent department on each violator of laws or regulations. The Algerian legislator followed this trend by imposing a variety of different administrative sanctions, whether on natural or legal persons who commit administrative violations. It is distributed through a number of laws that cover a variety of fields and industries, such as taxes and public health, in addition to the sector of the media with all of its poles, including written, audio, and audiovisual content. However, the legislator is subject to the implementation of the administration's powers in the imposition of these penalties with legal controls that are considered to be guarantees of the rights of people who are dealing with it.
