المعرفة النّفسيّة و أثرها في توجيه الأحكام العقديّة- دراسة تأصيليّة Psychological Knowledge And Its Impact On Directing The Doctrinal Rulings - An Original Study

الملخص
يتناول هذا البحث مسألةً يعدّها ضروريّةً لتنزيل الأحكام الشّرعيّة، تنزيلًا صحيحا، لم يذكرها علماء أصول الفقه تصريحا ضمن شروط الاجتهاد و الفتوى، باعتبارهم العلماء الذين وضعوا الأصول و القواعد التي تبنى عليها الأحكام بناء سليما من الزّلل الذي يوقع في القول على الله بغير علم، و ظلم المكلّفين، هي معرفة أحوال نفوس المكلّفين عند الحكم عليها، لا سيّما في أمور الاعتقاد المتعلّقة بالتّكفير و شعبه المختلفة؛ لكنّها تفهم من عموم تلك الشّروط التي وضعوها للحكم الشّرعيّ، و تظهر لنا من عبارة بعض الفقهاء، كما تظهر جليّة عند النّظر في وقائع قصّها القرآن الكريم و هي موجّهةٌ بجملة أوامره(كالأمر بالتّبيّن)، و نواهيه(كالنّهي عن الظّنّ المجرّد)، و وقائع في السّنّة النّبويّة وجّهها النّبيّ–صلّى الله عليه و سلّم-(كالرّمي بالنّفاق الأكبر، و باللّعنّ، و كأعراض الوسوسة). This research deals with an issue that it considers necessary for the correct transmission of the legal rulings, which the scholars of jurisprudence did not explicitly mention within the conditions of ijtihad and fatwa, as they are the scholars who set the principles and rules upon which the rulings are built, a sound building from the errors that occur in saying about God without knowledge, and Injustice of those responsible, is knowing the conditions of the souls of those who are charged when judging them, especially in matters of belief related to atonement and its various branches; But it is understood from the generality of those conditions that they set for the legal ruling, and it appears to us from the words of some jurists, as it appears clearly when looking at the facts narrated by the Noble Qur’an, and it is directed by the totality of its commands (such as the command to make it clear), and its prohibitions (such as the prohibition of mere suspicion), and the facts of the Qur’an. In the Prophetic Sunnah, the Prophet - may God’s prayers and peace be upon him - addressed it (such as slandering with major hypocrisy, cursing, and symptoms of waswaas).
