آلية مناقشة مخطط عمل الحكومة أو برنامج الأغلبية البرلمانية وفقا للتعديل الدستوري لسنة 2020

الملخص
تخضع الحكومة لرقابة برلمانية قبلية من خلال ضرورة حصولها على ثقة البرلمان قبل شروعها في عملها، وتعتبر مناقشة مخطط عمل الحكومة أو البرنامج الحكومي أول محطة و أول إمتحان تختبر فيه من لدنه، حيث يطلع بالتفصيل على نشاطات الحكومة في كل القطاعات و إذا لم يرض عنها يعلن عدم موافقته و تقدم الحكومة استقالتها، وعلى غير ما عهدته الدساتير الجزائرية السابقة أحدث التعديل الدستوري لسنة 2020 تغييرا استثنائيا وفكرة جديدة فحواها الإتيان بمصطلحين دستوريين مختلفين هما الوزير الأول و رئيس الحكومة، يعين الأول إذا أفرزت الانتخابات التشريعية أغلبية رئاسية و يعد مخطط عمل الحكومة لتطبيق برنامج رئيس الجمهورية، ويعين الثاني إذا أفرزت الانتخابات التشريعية أغلبية برلمانية يسمح بتطبيق برنامجها ، لذلك نهدف من خلال هذا البحث تسليط الضوء على أهم المستجدات في هذا الخصوص ، وإبراز كيفية معالجة المؤسس الدستوري لهذه الآلية الرقابية من حيث إجراءاتها والآثار المترتبة عليها . Abstract: Discussion of the government's action plan or programme is considered to be the first stop and the first exam to be tested from the country. It is made aware of the government's activities in all sectors. If it is not satisfied, it will declare its disapproval and the government will resign. Apart from the fact that the previous Algerian constitutions gave the most extraordinary change in the 2020 Constitution and a new idea of two different constitutional terms, the Prime Minister and the Head of Government, the former is appointed if the legislative elections give a presidential majority and the Government's action plan is prepared to implement the programme of the President of the Republic. The second is appointed if the legislative elections give a parliamentary majority that will allow for the implementation of its programme and, So through this research we aim to highlight the most important developments in this regard and highlight how the constitutional foundation of this oversight mechanism addresses its procedures and implications.
