النظام القانوني للاستقالة في ظل قانون الوظيفة العمومية الجزائري 06-03

الملخص
تطرقت الدراسة الى موضوع الاستقالة و الذي يعد من أهم مواضيع قانون الوظيفة العامة ،و قد حاول المشرع الجزائري أن يكفل هذا الحق للموظف العام من خلال الأمر رقم: 06-03 المتضمن القانون الأساسي للوظيفة العمومية ، حيث تعد الاستقالة من بين الأسباب التي تنتهي بها العلاقة الوظيفية و ما يترتب عليها من فقدان الموظف للصفة الوظيفية، ولذلك كان من الضروري تنظيم هذا الحق بنصوص قانونية من شأنها أن تضبط أحكامها بما يضمن حق الموظف في ترك الوظيفة بصفة نهائية من جهة و يضمن ديمومة سير المرفق العام بانتظام واطراد من جهة أخرى. Abstract This study shed light on resignation which is regarded as one of the most important themes in the public service law. The Algerian legislator sought to guatantee this right for the public servant in the ordonnance n° 03 -06 which comprised the fundemental law. Reisgnation is considered as one of the major causes of ending service thus losing the employment status. So it was necessary to maintain this right with legislations that could in one hand enable the employee to abandon the job permanently and guarantee the functionality of the public facility on the other hand.
