إشكالية تفويض صلاحيات رئيس الجمهورية في ظل الظروف الاستثنائية - وباء كورونا أنموذج- على ضوء التعديل الدستوري الجزائري 2020

الملخص
اعترفت مختلف الدساتير الجزائرية وآخرها التعديل الدستوري لسنة2020 الصادر بالمرسوم الرئاسي20/442، لرئيس الجمهورية صلاحية ممارسة الإجراءات الضبطية في إطار الحفاظ على أمن وكيان الدولة لمواجهة الظروف الاستثنائية، وتعد هذه الاختصاصات لصيقة به فهو الشخص الوحيد المخول له إقرارها واتخاذها دون إمكانية التنازل عنها لشخص آخر. وبانتشار وباء كورونا الذي أعلنت عنه منظمة الصحة العالمية كوباء عالمي،يمكن لرئيس الجمهورية اتخاذ كافة التدابير بغية الحفاظ على أرواح وممتلكات المواطنين وتحقيق أمنهم. والملاحظ عن تفويض سلطته لمواجهة الوباء،أنه لا يوجد نص يبين ذلك، لأن قرار التفويض يجب أن يكون صريحا وكتابيا. .Various Algerian constitution ,the latest of which was the constitutional amendment of 2020 promulgated by presidential decree 442/20,recognized the president of the republic’s authority to exercise control measures within the framework of preserving the security and entity of the state to face exceptional circumstances ,and these competencies are close to him , as he is the only person authorized to approve and take them without the possibility of ceding them to another person. And with the spread of the corona epidemic ,which was declared by the world health organization as a global epidemic ,the presdent of the republic can take all measures in order to preserve the lives and property of citizens and achieve their security ,it is noted about delegating his authority to confront the epidemic ,that there is no text that shows this ,because the decision to delegate must be explicit and in writing.
