الملخص
الملخص: يتمحور هذا البحث في أثر فقدان الزوج على استمرار الرابطة الزوجية والفترة التي يجب على الزوجة تربصها لاستصدار الحكم بالوفاة، وحول عدّة الوفاة بالنسبة لها ومتى يبدأ سريانها، هل من تاريخ الحكم بالوفاة أو من تاريخ الفقد وهل تحتسب بأثر رجعي وهذا استنادا إلى ما ذهب إليه المشرّع الجزائري في المادة 59 من تقنين الأسرة، كما سيتمحور حول تبيان موقف الفقه الإسلامي بمذاهبه الأربعة وموقف التشريعات العربية من ذلك. . Abstract: This research focuses on the impact of the loss of the husband on the continuity of the marital bond and the period that the wife must wait before requesting a verdict of the husband’s death , and also about her IDDAT waiting period and when does it start to take effect, is it from the date of the death pronouncement or from the date of loss and is it calculated retroactively based on what the Algerian legislator went to in Article 59 of the Algerian family law ; twill also focus on clarifying the position of Islamic jurisprudence with its four schools of thought, and the position of Arabic legislations in this regard.
