مسألة تجزّؤ الاجتهاد، نشأتها، وتطورها في كتب أصول الفقه.

الملخص
ملخص: تناولت في هذه الدراسة نوعا جديدا ونمطا مبتكرا في دراسة مسائل أصول الفقه, غير الذي اعتاد الباحثون السير عليه, كان محور الدراسة وقوامها رصد التطوّر التاريخي لمسألة: تجزؤ الاجتهاد, عبر كتب الأصول منذ تدوينه إلى آخر ما استقرت عليه المصنفات فيه, وتسجيل مختلف التغيرات التي طرأت على المسألة الأصوليّة, من جهة عنوانها وترجمتها والأقوال فيها, وقد خلصت بعد دراستها إلى أنّها انبعثت من مبحث شروط الاجتهاد المطلق, وأوّل من أشار إليها هو أبو الحسين البصري, كما أنّ أوّل من عبّر بلفظها (التجزؤ) هو الغزالي في المستصفى, وأوّل من أفردها بمبحث مستقل هو ابن الحاجب في مختصره, وأوّل من عرض الخلاف فيها بين المانعين والمجيزين هو الرازي في المحصول, وقد استقرت المسألة في الأخير على أربعة أقوال, وثمرتها في النظر الأصوليّ اعتبار خلاف الأصوليّ في الفقه, وفي غيره من العلوم. Abstract: The main subject of the research and its stature: records of the historical progress of this matter: fragmentation of Ijtihad, from the books of Islamic jurisprudence (Usool Fiqh), from the time they were compiled to the last place the compilations settled and recording the different changes that faced the Islamic jurisprudence (Usool Fiqh) matters. From the angle of its title, translation and sayings regarding it. I have concluded after studying it that this matter comes from the conditions of absolute Independent reasoning (Ijtihad), and the first person to point this out was Abou AL- Hossein Al-Basry and the first to mention the word “Tajazzu’” (Fragmentation) was Al-Ghazali in his book called "Al-Mustasfa". The first to single it out in research was Ibn Al-Hajib in his book called "Mukhtasar". The first to mention the differences of opinions regarding it, between those that permit it and those that don't permit it, was Ar-Razi in his book called "Al-Mahsool". The matter was summarized at the end with four opinions, and its benefits according to Islamic Jurist ( Al- Usooli) is putting into consideration the Jurist (Al-Usooli) differences in islamic jurisprudence, and in other field of knowledge.
