الملخص
الملخص: تعد جريمة اختطاف الأطفال من الظواهر الإجرامية الخطيرة التي تفشت واكتسحت المجتمعات بشكل ملحوظ في الوقت الحاضر، ويكون لهذا السلوك الإجرامي تأثيراً بالغاً على الطفل والمجتمع والدولة؛ إذ أن هذه الجريمة تلحق أضراراً جسيمة بالطفل الذي بحكم ظروفه وعدم نضوجه وعجزه عن صد الاعتداء الذي يقع عليه يكون أكثر عرضة من الفئات الإنسانية الأخرى في أن يكون ضحية هذه الجريمة. لذا امتد الاهتمام بالطفل وحماية حقوقه وحظر الانتهاكات والاعتداءات التي ترتكب بحقه إلى النطاق الدولي ليدخل ضمن اهتمامات المجتمع الدولي والقانون الدولي. وعليه ارتأينا أن نتطرق بالدراسة مدى اهتمام المجتمع الدولي لوضع حد لهذه الظاهرة اللاإنسانية وحظرها من خلال النصوص القانونية الواردة في الاتفاقيات الدولية كآلية لضمان ذلك. ولمعالجة هذا الموضوع تم الاعتماد على أكثر من منهج علمي واحد، منها المنهج الوصفي والتحليلي. وقد حاولنا أن نتناول محاور هذا الموضوع وفق خطة منهجية مقسمة إلى قسمين، يتم في الأول تبيان مفهوم جريمة اختطاف الأطفال، فيما سنفرد الثاني إلى تناول التكريس الدولي لحظر جريمة اختطاف الأطفال في نصوص الاتفاقيات والمواثيق الدولية. Abstract: The crime of child abduction is one of the serious criminal phenomena that have spread and swept societies significantly at the present time, and this criminal behavior has a profound impact on the child, society and the state, as this crime causes serious damage to the child who, by virtue of his circumstances, immaturity and inability to repel the abuse that occurs to him is More likely than other human groups to be a victim of this crime. so the concern for the child, the protection of his rights and the prohibition of violations and attacks committed against him extended to the international sphere to fall within the concerns of the international community and international law. Accordingly, we decided to address the study the extent of the international community’s interest in putting an end to this inhuman phenomenon and prohibiting it through the legal texts contained in international conventions as a mechanism to ensure this. We have tried to address the axes of this subject according to a systematic plan divided into two parts. In the first, the concept of the crime of child abduction is explained, while we will devote the second to addressing the international dedication to the prohibition of the crime of child abduction in the texts of international conventions and covenants.
