الملخص
ملخص: إن انطباع خصائص الشريعة الإسلامية بشمولها وكمالها، وموافقتها للفطر على منحى المالكية الأصولي؛ اكسب أصولهم الاتساع في اتساق ومرونة، مما مخَّض اختيارات خصوا بها في الأصول، فعدت من مفرداتهم، وكان لها الأثر الجلي في الاختيار الفقهي ببعده النقلي والعقلي، وما هذه الدراسة إلا محاولة لتجلية ما تفردوا به عن غيرهم - الحنفية والشافعية والحنابلة ـ من اختيارات أصولية في باب الحكم الشرعي، وأثرها الفقهي. Abstract: The impression of the characteristics of Islamic law in its comprehensiveness and perfection, and its suitability to the fungus; on the basis basis of the fundamentalist Malikya; their assets gained wide consistency and flexibility, resulting in choices in their assets, so they returned from their vocabulary and had a clear impact on the jurisprudential choice of its mental and intellectual dimension, And this study is only an attempt to illustrate what they singled out from others - from Hanafis, Shaafa'is and Hanbalis - from the fundamentalist choices in the section of the Islamic ruling from the doors of the science of assets And its realistic effect.
