الملخص

تعد بورصة القيم المنقولة إطاراً لتنظيم وسير العمليات المتعلقة بالقيم المنقولة التي تصدرها الدولة والأشخاص الآخرون من القانون العام وشركات المساهمة. ويعد التحكيم إحدى الآليات التي أقرتها معظم التشريعات القانونية في مجال الأوراق المالية لتسوية النزاعات فيها. والأصل أن نظام التحكيم اختياري، إلا أن المشرع الجزائري نص في المادة 52 من المرسوم التشريعي رقم 93/10 المتضمن بورصة القيم المنقولة المعدل والمتمم على إجبارية التحكيم في المسائل المتعلقة بالنزاعات ذات الطابع التقني بين الوسطاء في عمليات البورصة أو الوسطاء وشركة تسيير بورصة القيم المنقولة، أو الوسطاء والشركات المصدرة للأسهم، أو الوسطاء والآمرين بالسحب. وتُعهد مهمة ذلك للغرفة التأديبية والتحكيمية على مستوى لجنة تنظيم ومراقبة عمليات البورصة باعتبارها سلطة ضبط مستقلة. The TSE is a framework for organizing and conducting operations related to movable values issued by the state and other persons from public law and joint stock companies. Arbitration is one of the mechanisms approved by most legal legislations in the field of securities to settle disputes therein. The principle is that the arbitration system is optional. However, the Algerian legislator stipulated in Article 52 of Legislative Decree No. 93/10 that includes the amended and supplemented movable values exchange on the compulsory arbitration in matters related to disputes of a technical nature between brokers in the operations of the stock exchange or intermediaries and the company operating the TSE, Or brokers and companies issuing shares, or brokers and directors of withdrawal. The task of this is entrusted to the Disciplinary and Arbitration Chamber at the level of the Committee for Regulating and Supervising Stock Exchange Operations, as it is an independent control authority.
