معوقات تطبيق العدالة أمام المحكمة الجنائية الدولية

الملخص
الملخص: تعتمد المحكمة الجنائية الدولية في أداء المهام المنوطة إليها على جملة من المبادئ الهامة التي تساهم بشكل رئيسي في ضمان التطبيق السليم القانوني للعدالة الجنائية الدولية، كالمبادئ المتعلقة بالمجرمين مرتكبي الجرائم الدولية، منها مبدأ عدم الاعتداد بالحصانات ومبدأ المسئولية الجنائية الفردية. ورغم ذلك فإن تطبيق وتجسيد هذه المبادئ لا يحظى بالبساطة التامة وإنما تعترضه العديد من العراقيل والصعوبات التي تعيق السير العادي للمحاكمة العادلة أمام المحكمة الجنائية الدولية، وتنقسم هذه المعوقات إلى معوقات قانونية كسلطة مجلس الأمن في الإحالة، ومعوقات سياسية كالتذرع أمام المحكمة بمبدأ سيادة الدولة على أراضيها. Abstract: Supports the International Criminal Court in the performance of tasks assigned to it, among other important principles, which contribute mainly to ensure the proper application of international criminal justice, as the principles relating to the criminal perpetrators of international crimes, including the principle of irrelevance of immunities and principle Individual criminal responsibility. However, the application and the embodiment of these principles does not enjoy full simplicity but encountered many obstacles and difficulties which impede the normal functioning of a fair trial before the International Criminal Court, divided them into legal impediments, such as the authority of the Security Council referral, and political constraints as an excuse In court, the principle of State sovereignty. .
