دور مجلس المنافسة الجزائري في مراقبة التجميعات الاقتصادية

الملخص
نص المشرع على آليات للسهر على حماية النظام التنافسي بغرض القضاء على الممارسات المقيدة للمنافسة، والتجميعات الاقتصادية غير المرخص بها، مانحا لمجلس المنافسة صلاحيات واسعة في إطار رقابته للتجميعات الاقتصادية، من خلال الرقابة السابقة بحكم أن هذه التجميعات يتعين أن تحصل على تراخيص من المجلس، ورقابة لاحقة يمارسها المجلس على التجميعات الاقتصادية من خلال العقوبات التي يفرضها المجلس في حال مخالفتها للتشريع والتنظيم المعمول به وخرقها لقواعد الشفافية والمنافسة الحرة، في المقابل يتقيد المجلس بعدة قيود موضوعية وشكلية فرضت لحماية المصلحة العامة، بالإضافة إلى إمكانية الطعن في قراراته أمام مجلس الدولة طبقا للمادة 19 من الأمر 03-03، المتعلق بقانون المنافسة خلافا لقراراته الاخرى التي يطعن فيها أمام الغرفة الفاصلة في المواد التجارية بمجلس قضاء الجزائر العاصمة The legislator stipulated mechanisms to ensure the protection of the competitive system with the aim of eliminating practices that restrict competition and unlicensed economic groupings, granting the Competition Council broad powers within the framework of its control of economic groupings, through previous oversight by virtue of the fact that these groupings must obtain licenses from the Council, and control A subsequent exercise by the Council on economic groupings through the penalties imposed by the Council in the event that they violate the legislation and regulation in force and violate the rules of transparency and free competition.On the other hand, the Council is bound by several substantive and formal restrictions imposed to protect the public interest, in addition to the possibility of challenging its decisions before the Council of State in accordance with Article 19 of Ordinance 03-03, related to the competition law, in contrast to its other decisions that are challenged before the separation chamber in the commercial articles of the Judicial Council of Algiers
