حل المجلس الشعبي الوطني في ظل التعديل الدستوري سنة 2020

الملخص
منح المؤسس الدستوري الجزائري في التعديل الدستوري سنة 2020 لرئيس الجمهورية سلطة تقديرية في حل المجلس الشعبي الوطني دون أن يضبط هذه السلطة خصوصا من ناحية تحديد أسباب الحل، وهذا ما يشكل تهديدا للسلطة التشريعية المكلفة بالتشريع ورقابة عمل الحكومة حيث يحل رئيس الجمهورية محل المجلس الشعبي الوطني أثناء شغوره بوظيفة التشريع، غير أنه وضع المؤسس الدستوري بعض الضوابط الإجرائية يتعين احترامها قبل توقيع رئيس الجمهورية مرسوم الحل، كما حدد آجال معقولة لتجديد المجلس الذي تم حله من خلال تنظيم الانتخابات التشريعية في أجل أقصاه 03 أشهر يمكن تمديدها للمدة نفسها بشروط.
