الحماية القانونية للمقدسات الدينية "دراسة على ضوء القانون الجزائري والمواثيق الدولية" Legal Protection Of Religious Sanctities "a Study In Light Of Algerian Law And International Conventions"

الملخص
ترتكز المقدسات الدينية على الاعتقاد الروحي لدى البشر، حيث تتعلق بها روح الشخص، وتصبح جزءا أساسيا في كيانه، مما يستوجب بسط الحماية القانونية عليها كما تبسط على العناصر الأخرى المتعلقة بحياة الإنسان، وفكره، وماله ومسكنه، وشرفه، وثقافته، وتختص المقدسات الدينية في الشريعة الإسلامية بالاتساع، فلا تعني الأماكن المقدسة فحسب، بل تتضمن مجموع العناصر المرتبطة بالجانب العقائدي لدى المسلمين، سواء ما تعلق بالإيمان، والعبادات، والحدود، والمعاملات، والشخصيات، وقد أوجب ذلك على المشرع الجزائري إقرار جملة من الضمانات التي تصون المقدسات الدينية الإسلامية، في قانون العقوبات وقوانين الإعلام، وكذا ضمان ممارسة الشعائر الدينية لغير المسلمين، وتوفير الحماية القانونية لمقدساتهم الدينية. وبالرغم من الأحكام التي تنص عليها المواثيق الدولية لحماية المقدسات الدينية، والتي توجب قيام المسؤولية الدولية المدنية والجنائية في حال المساس بها والإساءة إليها، غير أن هذه المسؤولية تصطدم دوما بمعوقات تطبيق الأحكام الجنائية الدولية، خاصة عندما يتعلق الأمر بالمقدسات الدينية الإسلامية Religious sanctities are based on the spiritual belief of human beings, where they relate to the spirit of the person, and become an essential part of his being, which requires the extension of legal protection on them as well as the other elements related to human life, thought, money and residence, honour and culture, and the religious sanctities in Islamic law is broad, not only for the holy places, but also whether it relates to faith, worship, borders, transactions and personalities, and this has necessitated of the Algerian legislator to adopt alot of guarantees that preserve religious sanctities Islamic, in the Penal Code and media laws, as well as ensuring the practice of religious rites for non-Muslims, and the provision of legal protection for their religious sanctities, and despite the provisions of international conventions for the protection of religious sanctities, which require international civil and criminal responsibility in the event of harm and abuse, but this responsibility always encounters obstacles to the application of international criminal provisions, especially when it comes to Islamic religious sanctities.
