Les Sources Des Conflits Sur La Propriété Privée En Algérie

Résumé
Notre recherche a pour but d’analyser les sources des conflits liés fortement à la propriété privée à vocation agricole en Algérie. Parmi ces sources nous sommes basés sur le principe de l’indivision des terres Melk non titrés, l’occupation informelle du sol et le pluralisme juridique. Afin d’examiner l’origine ces sources qui représentent un obstacle majeur à la stabilité et la sécurité de la propriété foncière individuelle, nous avons recourir à l’évolution historique de régime foncier en Algérie. Enfin, on déduit que parmi les causes qui ont conduit le régime foncier après l’indépendance à l’anonymat il y a le grand nombre des législations et leur incohérence avec la réalité sociale. : Our research aims to analyze the sources of conflicts strongly linked to private agricultural property in Algeria. Among these sources we are based on the principal of undivided Melk land, informal land tenure and legal pluralism. In order to examine the origin of these sources which represent a major obstacle to the stability and security of individual land ownership, we have recourse to the historical evolution of land tenure in Algeria. Finally, we deduce that among the causes that led the land tenure after independence to anonymity there is the large number of laws and their inconsistency with social reality.
