النظام القانوني لرخصة البناء في القانون الجزائري

الملخص

فرض المشرع الجزائري رخصة البناء في تشريعات التعمير كآلية قانونية لتنظيم عمليات البناء والحفاظ على النظام العام العمراني، وذلك بوجوب الحصول عليها مسبقا قبل البدأ بأشغال البناء، فهي قرار إداري صادر من سلطة مختصة قانونا، ويتم ذلك وفق شروط و إجراءات يلتزم بها الفرد والإدارة للحصول على القرار المتعلق برخصة البناء، كما رتب المشرع جزاءات في حالة مخالفة الأحكام المتعلقة بها. الكلمات المفتاحية: رخصة بناء، طلب، إصدار قرار الرخصة، تجريم مخالفات أحكام الرخصة. Abstract The Algerian legislator has imposed the building permit in the urbanism law as a legal mechanism for regulating construction operations and maintaining urban public order, before starting the construction works, the permit must be obtained, it is an official approval issued by the local government agency legally competent. It is done according to the conditions and procedures by which the individual and the administration are obliged to obtain the decision on the building permit.
