الملخص
يعدّ البحث في دلالات الألفاظ من أهمّ المسائل الأصولية التي انمازت دراستُها بالدقة والتمحيص، وأسيل حولها كثير من الحبر من قِبَل الأصوليِّين واللغويين على حدّ سواء، فضلا عن الأهمية التأسيسية لتلك الدلالات في استنباط الأحكام من أدلتها الشرعية، لأن استنباط الأحكام واستقرائها من النصوص يمرّ بطرائق عدة، أولها معرفة أوضاع الألفاظ بالنسبة للمعاني والدلالات، وبعدها ماهية التداول اللفظي لتلك المعاني، وأخيرا طرائق الاستنباط عبر ما يطلق عليه بالدلالات، فهي بمنزلة قواعد أصولية لغوية تحدّ منهجا للاجتهاد في استثمار طاقات النصّ كلها في الدلالة على المعنى. ولا يمكننا عزل علم الأصول عن علوم اللغة أو فهم الأحكام من النصوص باللغة فحسب، فقواعد الأصول ليست نفسها قواعد النحو التي يتوصل بها إلى المعنى الظاهر من القول، بل مناهج يتوصل بها إلى دلالات التشريع ومفاهيمه . وكذا الاستدلال مما تناوله علماء اللغة لدلالة الألفاظ على معانيها المنطوقة والمفهومة سواء بدلالة النص( فحوى الخطاب) وإذا كان علماء البيان قد أشاروا إلى المعنى ومعنى المعنى. فإن البحث الأصولي أتى بما هو أزيد من معنى المعنى في دلالة المفهوم. ونحن في ورقتنا العلمية سنتناول حد دلالة المفهوم لدى علماء الأصول محاوليين إضاءته وقراءة هذا المفهوم المدروس بعطاءات الدرس اللساني الحديث. Research on semantics is one of the most important issues in jurisprudence that has been distinguished by accuracy and recourse methodology. Many studies jurisprudence scholars and linguists tackled this issue. In addition to the foundational importance of these significances in deriving legislative rulings from their legal evidence, as deriving and extrapolating of these legislative rulings from texts goes through several ways. The first is selecting the conditions of words in relation to meanings and connotations, and then the nature of the verbal exchange of those meanings, and finally the methods of deduction semantics. To understand the rulings from texts, it is not possible to isolate the science of jurisprudence from the linguistics, for the rules of jurisprudence are not the same as the rules of grammar by which we understand the apparent meaning of the utterance, but rather the methods to understand the connotations of the legislation and its concepts. As well as inference from what linguists have dealt with for the significance of words on their uttered or implied meanings, whether in terms of the text (Content of the discourse), and if the scholars of the rhetoric have referred to by the meaning and the meaning of the meaning. In this paper we will deal with the definition of the concept for the scholars of jurisprudence, trying to illuminate the concept in the modern linguistic approaches.
