الملخص
قد تتعرض السفن أثناء الرحلات البحرية لحوادث عديدة، تختلف أسباب وقوعها، فمنها ما تتسبب فيه الظروف الطبيعية، كاضطراب البحر والرياح والضباب وغيرها من مظاهر القوة القاهرة، ومنها ما يقع بفعل الإنسان، الأمر الذي يستدعي إلقاء الضوء على صور وأنواع الخطأ التي تلحق بالسفينة وغيرها، بالإضافة إلى التعرف على أشخاص الملاحة البحرية، المتسببين في وقوعه، بحكم اشتغالهم في السفينة. نذكر منهم: المجهز والربان وأفراد الطاقم ...الخ وقد كان للاجتهاد القضائي الحظ الوافر في إثراء هذه المسألة القانونية، من خلال متابعة النزاعات المطروحة على القضاء وتحليل دقيق لقرارات صدرت عن المحكمة العليا بشأنها، وهي- نافذة استطلاع واقعية على مجريات الرحلات البحرية. Ships during cruises may be exposed to numerous accidents, its occurence is caused by different reasons. Some accidents are due to climate circumstances such as: disturbance of sea, wind, fog and other manifestations of force majeure, where as others are caused by human errors.This issue requires shedding light on the images and types of error that inflict ships and others, in addition to identify the maritime men who caused it by virtue of their work in the ship, we mention: Captain of the ship, maintenance workers, crew members...etc In this regard, jurisprudence plays an important role in enriching this issue by following up the disputes before the judiciary and by analysing carefully the decisions which are realistic survey window on the course of cruises.
