الاجتهاد المقاصدي بين المفهوم والضوابط وارتباطه بقضايا العصر

الملخص
تناول البحثُ موضوعًا في غايةٍ من الأهمِّية متمثِّلا في الاجتهاد المقاصدي، وقدْ ازداد هذا الأخير تأكُّدا واهتمامًا في الآونة الأخيرة لطبيعة قضايا العصر الحالي والتي هي في حاجة ماسَّة إلى معالجتها في ضوء الاجتهاد المقاصدي ،ونظراً لحداثة هذا الموضوع جاء البحث بهدفِ الكشفِ عن طبيعتةِ من حيث المفهوم والضَّوابط والمكانة التي تبوَّأها في القرآن والسنَّة مع الإشارة إلى مؤهلات المجتهد باستخدامه للمقاصد ،متَّبعاً في ذلك المنهج الوصفي والتحليلي ،فتوصل إلى حاجة الاجتهاد للمقاصد عند إصدار أحكام تتعلَّق بقضايا العصر ،وأنَّ للاجتهاد المقاصدي ضوابط تحكمه وتضبطه كعدم معارضته للنَّص والعرف والقياس والإجماع... ممَّا يستدعي مدارسته بجدِّية وبعمق لكونه يعزِّز آلية من آليات الشَّريعة الغرَّاء. The research dealt with a very important topic represented in the objective ijtihad, and the latter has increased in certainty and interest in the recent times to the nature of the issues of the current era, which are in dire need to be addressed in the light of the objective ijtihad, and due to the recentness of this topic, the research came with the aim of revealing its nature in terms of the concept. And the controls and position that he occupied in the Qur’an and the Sunnah, with reference to the qualifications of the mujtahid in his use of objectives, following the descriptive and analytical approach, so he reached the need for ijtihad for objectives when issuing rulings related to the issues of the age, and that objective ijtihad has controls that govern and control it, such as not opposing text, custom, analogy, and consensus... It calls for studying it seriously and deeply, because it reinforces one of the mechanisms of the adhesive Sharia .
