ملخص: إنّ المتابعة القضائية على الانتهاكات الجسيمة لحقوق الإنسان يتطلب إنشاء هيئة قضائية مختصة، وهو الأمر الذي دفع بالاتحاد الإفريقي لمطالبة هيئاته المختصة بتسريع إجراءات توسيع اختصاص المحكمة الإفريقية للعدل وحقوق الإنسان لتشمل المعاقبة على الجرائم الدولية، حيث اعتمد الاتحاد الافريقي في جوان 2014 بروتوكول مالابو، وبالرغم من عدم دخوله حيز النفاذ الى غاية الآن، إلا أنّ الدراسة النظرية لأحكامه تُظهر مجموعة من المخاوف والتحديات، والتي يجب إزالتها عن طريق تعديل جديد لأحكام محددة في هذا البروتوكول حتى تصبح هذه المحكمة أكثر المحاكم الإقليمية فعالية. Summary The judicial follow-up of gross human rights violations requires the establishment of a criminal judicial body, which has led the African Union to demand that its competent bodies accelerate the procedures for expanding jurisdiction. of the African Court of Justice and Human Rights to include the sanction of international crimes. In June 2014, the African Union adopted the Malabo Protocol, and despite the fact that it has not yet entered into force, but a desk study of its provisions reveals a set of concerns and challenges, which must be addressed. through a new modification of the specific provisions of this protocol so that this tribunal becomes the most efficient regional tribunal.
